Article 2 — Purpose
These Terms & Conditions apply to all orders placed via https://barry-horton.com/newsite. Most pieces are made to order, using traditional handcraft methods.
Article 3 — Price
Prices are shown in euros. Under Article 293 B of the French CGI, VAT is not applicable — prices shown are therefore net of VAT.
Shipping is charged separately, at actual carrier cost plus a packaging fee of approximately €1.50. The exact amount is confirmed before payment.
Article 4 — Order and payment
Payment is due in full at the time of order, before production begins.
Once payment is received, we will send a confirmation email notifying you that production is starting. This email may include the ordering of special timbers or hardware for your piece.
Article 5 — Right of withdrawal
Under Article L.221-18 of the French Consumer Code, you have a 14-day right of withdrawal from the date of order.
However, under Article L.221-28 of the French Consumer Code, this right does not apply to goods made to the consumer’s specifications or clearly personalised. The start of production, as notified by the email described in Article 4, marks the point after which withdrawal is no longer possible.
Any withdrawal request made before that email is sent should be sent via our Contact page and will result in a full refund.
Article 6 — Delivery
We ship to France, most EU countries, the UK, and a limited number of other countries. Contact us before ordering if you’re unsure whether we ship to your location.
Production and delivery times vary by piece; an estimate is provided at the time of order.
Risk transfers to you on delivery. Ownership transfers once payment has been received in full.
Article 7 — Customised pieces
Any piece made or customised to your specification (dimensions, materials, finish, engraving, etc.) cannot be exchanged or refunded once production has begun, except in the case of damage found on delivery (see Article 8).
Article 8 — Damage in transit
Every piece is handmade using hand tools and checked before it leaves the workshop. If your piece arrives damaged in transit, contact us within 48 hours of delivery with photos of the item and packaging. We will arrange a repair, replacement, or refund as appropriate. This does not affect your statutory rights regarding faulty goods.
Article 9 — Mediation and disputes
Under Article L.616-1 of the French Consumer Code, consumers have the right to free recourse to a consumer mediator in the event of a dispute. Details of the relevant mediator are available on request via our Contact page.
These Terms & Conditions are governed by French law. In the absence of an amicable resolution, disputes fall under the jurisdiction of the French courts.
